- Information to be kept with wills
- Multiple jurisdiction wills and probating
- Testamentary trusts versus inter vivos trusts
- Standby trusts

Other Testamentary Issues

- Marriage & common law spouses / partnership relationships
- Community of property and financial resource property
- Nuptial agreements and their implications
- Matrimonial property and resulting, constructive and family trust issues

The above issues are set in the context of relevant HK law and relevant legal cases

Who should attend

The course is primarily targeted to those who would like to pursue “Trust Training Certificate” in order to apply for the Hong Kong Trustees’ Association Certified Trust Practitioner? designation.

It is also relevant to those who would like to gain a solid understanding of the course subject matter.

Speaker/Course Instructor

Thelma KWAN
Thelma Kwan is a Barrister specializing in family and trust law in Hong Kong. She has previously spent 24 years in the private banking industry, in the trust and wealth planning segment of various private banks. Her last role, before returning to legal practice, was Head of Wealth Advisory for Asia Pacific for a large UK Bank running a team of wealth advisers in the Asia region. While her mandates were various, Thelma’s interest and focus had been serving clients in their wealth planning needs with a holistic approach; taking into regard issues including family succession planning, asset protection, business succession, and cross border tax issues.
Freda LIM
Ms Lim is a partner in Hugill & Ip Solicitors. Having been in the private practice for nearly 15 years, Freda continues to stay focused in serving her onshore as well as offshore clients in dealing with a broad spectrum of private client work ranging from family-related issues, estate planning, trust set up, tax, Part II application under the Mental Health Ordinance, probate and estate disputes. Apart from individuals, Freda also works closely with international law firms and professional trustees in advising companies with respect to their pre-IPO trusts and employee benefit schemes. Freda’s invaluable experience in dealing with local and overseas post-death issues such as probate and estate administration has made her a unique private client lawyer when it comes to will-drafting for clients with cross border interests and assets. Freda believes each client has an exclusive preference when dealing with his or her wealth planning. Hence, she is committed in bringing personalized care and tailored made solutions for her clients when handling their family and wealth issues under different contexts. Freda enjoys philanthropy work and she extends her practice in giving pro bono services to charitable institutions, advising them on legacy giving initiatives. She also helps her clients in the setting up of charitable companies.
