Trust Training Certificate (TTC) - Unit 14: Foundations Law - Part 1 (4th Cohort)
Overview
This eCourse will be accessible from 9 August to 4 December 2021.
This is Unit 14 of the training programme in pursuing the “Trust Training Certificate”.
This eCourse is developed based on the recorded webinar session of Unit 14 held on 25 May 2021. For participants who will take the TTC Part B Examination in December 2021, please ensure you read the latest version of study guide and materials provided via the examination enrollment link.
It consists of two modules:
Module 22: Foundations Overview
Module 23: Parties to a Foundation and their Roles
Objective
On completion of the course, you will be able to:
1. Understand how a foundation differs from a trust
2. Explain when a foundation is more appropriate than a trust
3. Understand the legal form of documents and formalities of a foundation
4. Understand the various parties to a foundation
5. List the parties in a foundation and explain their roles compared with the parties and roles in a trust.

Module 22: Foundations Overview
1. Establishment and registration
2. Charter and Articles / Rules
3. Language, form and validity
4. Purpose and change of Purpose
5. Asset protection and anti-forced heirship
Module 23: Parties to a Foundation and their Roles
1. Different parties: founder, council, officers, resident, agent, secretary, supervisory person, beneficiaries, guardian
2. Duties and powers of these parties
3. Retention of control:
(a) Founder’s powers and rights
(b) Foundation as a PTC
(c) Foundation / Limited Partnership Structure
Who should attend
The course is primarily targeted to those who would like to pursue “Trust Training Certificate” in order to apply for the Hong Kong Trustees’ Association Certified Trust Practitioner™ designation.
It is also relevant to those who would like to gain a solid understanding of the course subject matter and / or those who plan to enter the Trust industry sector.
