Terms and Conditions for Using Online Enrolment System for Application/Enrolment and Payment

Before proceeding to payment, you are required to agree to the following Terms and Conditions.  Please read them carefully.

1. Acceptance of Terms

• By clicking "Agree", you acknowledge that you have read, understood, and agreed to comply with and be bound by these Terms and Conditions for using HKSI Institute Online Enrolment System (OES) for services provided defined under clause 2.
• If you do not agree, please do not proceed.

2. Provision of Services

• Our OES allows users to apply/enrol and make payment for events/activities and services related to examination, training and membership, offered by or through HKSI Institute. All descriptions of events/activities and services, and their related information such as fees, venues, eligibility, etc are subject to change.

3. User Responsibilities

• You are responsible for providing accurate and complete information and ensuring the security and confidentiality of your HKSI Institute ePlatform account information.

4. Payments

• Payment Methods: We accept most major credit cards and mobile payment platform. Please refer to Payment Methods for details.
• Processing: All payments are processed through our secure payment gateway. By proceeding to payment, you consent
  • to the processing of your payment information provided by you.
  • that you are the authorised holder of the credit card or mobile payment platform account
• A payment reference number will be generated for every successful transaction. If, for whatever reason a payment reference number is not shown within a reasonable period of time after submitting all the required details, you should contact HKSI Institute to check the payment status.
• Refund Policy: Refunds will be processed according to the refund policy specified for the respective services that you have applied/enrolled and paid. Please review this policy before proceeding.

• You understand that the technical processing and transmission in connection with the OES may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. HKSI Institute shall in no circumstances be liable for any failure of the OES in whole or in part or for your inability to gain access in whole or in part to the OES due to the delay or failure of any networks or any party providing such access.

5. Intellectual Property

• All content, materials, and resources available on the OES are the property of HKSI Institute and are protected by copyright laws. You may not use, reproduce, or distribute any materials without our prior written consent.

6. Personal Data

• HKSI Institute shall collect and hold personal data provided by you to process your enrolment and payment. Please refer to HKSI Institute's Privacy Policy which outlines how we collect, use and protect your personal information.

7. Indemnity

• You agree to indemnify, defend, and hold harmless HKSI Institute, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the services through OES, your violation of these Terms and Conditions, or any misrepresentation or breach of representation or warranty made by you.

8. Dispute Resolution

• Any disputes arising from your use of our services through OES will be governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China (Hong Kong SAR). You agree to resolve any disputes through mediation or arbitration before pursuing other legal remedies.

9. Limitation of Liability

• To the fullest extent permitted by law, HKSI Institute shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages including but not limited to damages for loss of profits, revenue, data, goodwill, resulting from your use of the services through OES. HKSI Institute's liability, if it is so held liable despite these terms and conditions, to you in relation to the services through OES shall be limited to the fees paid or payable to HKSI Institute or the direct damages sustained or HKD5,000, whichever is the least.

10. Severability

• If any one or more of these terms and conditions, or their application in any circumstance, is held invalid, illegal or unenforceable in any respect for any reason, the validity, legality and enforceability of that term or condition in any other respect and the remaining terms and conditions shall not in any way be impaired.

11. Third Party Rights

• You acknowledge that our services may include links to third-party websites or services that are not owned or controlled by HKSI Institute. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.
• By using our services, you acknowledge and agree that HKSI Institute shall not be liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such third-party content, goods, or services.
• Unless expressly provided to the contrary in these terms and conditions, a third party other than you and HKSI Institute has no right under the Contracts (Rights of Third Parties) Ordinance to enforce or to enjoy the benefit of any of these terms and conditions.

12. Amendments to Terms

• We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our site. Your continued use of our services constitutes acceptance of the revised terms.
