Suitability Obligations – Frequently Asked Questions (TPPWM17001801)


Course Overview

The Securities and Futures Commission (“SFC”) issued two Frequently Asked Questions (FAQs) on 23 December 2016 relating to suitability obligations. The first FAQ - “FAQ on Compliance with Suitability Obligations” is an update to the May 2007 FAQ and the second FAQ – “FAQ on Triggering of Suitability Obligations” is a new FAQ giving examples of situations when suitability obligations would likely be triggered.

The two FAQs set out some practical considerations that licensed or registered persons should consider in their requirement to observe suitability obligations under paragraph 5.2 of the Code of Conduct.

This 2-hour seminar will discuss the requirement of suitability obligations under the Code of Conduct and review the clarification and elaboration in the updated 2016 Suitability FAQ and when would suitability obligations be likely triggered.

Course Instructor: Ms Anna Wong

Ms Wong is currently a part time lecturer at the Faculty of Law of the University of Hong Kong teaching two core courses of the Master of Laws in Compliance and Regulations. Before she took up an academia role, Ms Wong was Head of Private Banking, Greater China at Credit Suisse. Ms Wong has extensive experience in regulatory matters, she had served as the Chief Executive Officer, Executive Officer and Responsible Officer of various financial institutions. Ms Wong is a Senior Fellow of the HK Securities & Investment Institute and an Honorary Advisor of the Hong Kong Institute of Bankers. Ms Wong holds a Bachelor of Arts and a Juris Doctor from the University of Hong Kong and a Master of Business Administration from the Chinese University of Hong Kong.

Who Should Attend

The seminar is catered to all licensed or registered persons and compliance or control staff who are in or interested in the Wealth Management business in both registered institutions and licensed corporations.

Financial Incentive Scheme of the WAM Pilot Programme

This seminar is one of the eligible courses/programmes under the financial incentive for professional training. In-service practitioners of the financial services industry will be eligible for the Scheme. They will be reimbursed 80% of the course fees, subject to a maximum of $7,000 (whichever is the lower) upon satisfactory completion of a course or seminar under the selected programmes of the Scheme. Each individual may apply for fee reimbursement for more than one course / seminar, up to a ceiling of $7,000 per person over the three-year period of the Scheme. Application to reimburse the course fees, together with the required documents, must be submitted within four months from the last day of the course attended. For “Suitability Obligations – Frequently Asked Questions” seminar, eligible individual can apply for reimbursement upon satisfactory completion of the seminar.
